California judge blocks portion of Trump’s sanctuary cities order

A federal judge in California has temporarily blocked a portion of President Trump’s executive order on sanctuary cities that was designed to pull federal funding from such jurisdictions.


Philadelphia, like other cities commonly defined as “sanctuary cities,” does not honor requests from federal immigration officials to hold undocumented immigrants in custody for nonviolent crimes. The city had braced for potential funding cuts when the order was signed in January, and officials said Tuesday they were “gratified” with the ruling by  Judge William Orrick of U.S. District Court in San Francisco, but were still reviewing his order.

“We will need to continue to work in order to prevent our local law enforcement officers from being forced to adopt policies that would make our city less safe and worsen community relations,” Mayor Kenney’s spokeswoman, Lauren Hitt, said in an email.


San Francisco and Santa Clara counties had argued that the executive order was unconstitutional and vague. Lawyers for the Trump administration had countered that the order never changed existing law and was only signaling the president’s priorities on immigration law.

Orrick wrote that the temporary injunction issued Tuesday did not mean administration officials couldn’t enforce conditions on certain Department of Justice grants that require compliance with immigration laws — and that the Trump administration can still come up with regulations that define what a sanctuary city is, and which cities in the U.S. are considered as such.
